Condition for purchase under foreign ownership

Under Thai laws, foreign nationals are not allowed to purchase a home or own residential land; however there are few alternatives to qualify as follows:

  • Corporate Ownership
    It must be a corporation that is registered with which under Thai law (land Code) requires that at least 51% of the shares are held by Thai nationals and a maximum 49% of the shares may be owned by foreign shareholder. The person must be listed in the director, executive or management level which has the ability to sign all documention.

  • General Ownership
    A foreigner must have a Thai spouse and the land could be bought under the name of the Thai spouse.
